This page contains and sets forth the terms of use concerning wattsallamericanmade.com (hereinafter referred to as the “Web Site”). Your continued used of this website constitutes your agreement to this legal agreement (“Agreement”) between you and Watt’s All-American Made (hereinafter referred to as “Web Site Owner”), the owner and developer of the Web Site. By purchasing any product provided on the Web Site or registering for any service on the Web Site, you become a client (“Client”) and you agree to be bound by the terms (the “Terms”) of this Agreement as long as you remain a Client. IF YOU DO NOT AGREE TO THE TERMS, PLEASE DISCONTINUE YOUR USE OF THE WEB SITE IMMEDIATELY. The Terms are subject to change at any time, effective upon notice to you.

  1. Limitations of Liability and Indemnification. By using any services provided by, or making any purchases through, the Web Site, you agree that in no event will the Web Site, Web Site Owner, its and their officers, employees, agents, affiliates, partners, licensees and web hosting services be liable for any direct or indirect, incidental, special or consequential damages as a result of your accessing the Web Site and using any of the services available. Your sole remedy for any breach or default of this Agreement by the Web Site or Web Site Owner shall be a return of any fees paid to the Web Site or Web Site Owner for any services or products provided under this Agreement. You indemnify and agree to defend and hold harmless the Web Site, Web Site Owner, its and their officers, employees, agents, affiliates, partners, licensees and web hosting services and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards or settlements) relating to or arising out of your use of the Web Site, including any breach by you of the Terms contained in this Agreement.
  2. Responsibility for Use of Web Site. You understand and agree that you are solely responsible for your actions and decisions by virtue of the services and shopping capabilities provided on the Web Site.
  3. Statement Concerning American-Made Products. Your trust in our sourcing of products is important to the Web Site Owner. To that end, the Web Site Owner has taken reasonable best efforts to verify that every product being sold here that is marked “Made in USA” or “American Made” meets all legal requirements for the use of such a term as laid out in the Federal Trade Commission's guidelines, and that the clothing being sold as "Made in USA using imported materials" meets all legal requirements for being eligible to use that term according to the same guidelines. If you find any product on the Web Site that you believe does not meet the FTC’s requirements for one or more of the aforementioned designations, please contact the Web Site Owner so that we can investigate. If our investigation discloses that the designation was erroneous, we will provide a full refund for that product to the individual bringing the problem to our attention, and will remove the product from the Web Site promptly.
  4. Invitation to Investigate. Subject to Section 3 of these Terms of Use, opinions, advice, statements or other comments from the Web Site or Web Site Owner are subject to the honor system laid out by the FTC. This means that the legal responsibility of proof regarding any product’s eligibility to use the terms mentioned in Section 3, and all other terms laid out in the FTC’s Made in USA Guidelines (both specific and inferred), falls on the manufacturers themselves rather than on the Web Site or Web Site Owner. The Web Site and Web Site Owner do not guarantee the accuracy or completeness of any of the information provided (such as, but not limited to, any reviews or commentaries by other users), and are not responsible for any loss resulting from your reliance on such information. The Web Site or Web Site Owner invites you to investigate all products you purchase, and encourages you to report any discrepancies you find as per Section 3 of these Terms of Use.
  5. Right to Monitor. The Web Site and Web Site Owner reserve the right, but are not obligated, to monitor materials posted in any public area and shall have the right to remove any information deemed offensive by our staff. Notwithstanding the foregoing, you remain solely responsible for your use of any information contained on the site.
  6. Confidentiality. It is agreed that all personal information given to the Web Site or Web Site Owner, will be kept confidential by the Web Site and Web Site Owner, with the following exceptions: (1) information you may choose to post for others to see; (2) comments made by you to the Web Site and/or Web Site Owner, which may be partially anonymized to withhold your last name and your town of residence (e.g., “Sally J. from Pennsylvania”).
  7. Ownership, Copyrights, Trademarks, Licenses. The Web Site and Web Site Owner own and retain all proprietary rights to the Web Site service, its trademarks and copyrights. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of the Web Site and Web Site Owner. By posting information to the Web Site and Web Site Owner you represent that you have the right to grant permission for use by the Web Site and Web Site Owner.

  9. No Warranties Except As Stated. Specifically, the Web Site and Web Site Owner do not warrant that: (a) the service, including but not limited to the shopping user interface, will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected; and (b) the products will always be in stock.
  10. Jurisdiction. This Agreement or any dispute arising from this Agreement is governed by the laws of the Commonwealth of Pennsylvania, without regard to provisions of conflicts of law. Any lawsuit arising from or related to this Agreement shall be brought exclusively before the United States District Court for the Middle District of Pennsylvania or any court of competent jurisdiction sitting in Bradford County, Pennsylvania, and you hereby consent to the jurisdiction of any such court.
  11. Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.
  12. Certification. You certify that you are at least 18 years of age and that your answers to the registration materials on the Web Site will be truthful. In accessing and using the Web Site, you understand and agree that basic information concerning you will be given to the Web Site and the Web Site Owner. Your name, address and e-mail address are kept confidential, except where provided elsewhere in this Agreement.
  13. Incorporation By Reference. The Web Site Owner’s Return Policy and Privacy Policy are incorporated by reference, as if set forth fully herein.
  14. Entire Agreement. This Agreement constitutes your entire Agreement with the Web Site and Web Site Owner with respect to any services and products provided through the Web Site.
